1. Agreement to Terms

Welcome to GolfSocietyHQ! These Terms of Service ("Terms") govern your access to and use of our golf league management platform located at www.golfsocietyhq.com (the "Service"), operated by GolfSocietyHQ ("we," "our," or "us").

By accessing or using GolfSocietyHQ, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

2. Eligibility

You must be at least 13 years old to use GolfSocietyHQ. By using our Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration and Security

3.1 Account Creation

To access certain features of GolfSocietyHQ, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account

3.2 Account Responsibility

You are solely responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

4. User Roles and Responsibilities

4.1 League Commissioners

As a League Commissioner, you are responsible for:

• Managing your league, including creating events and inviting members
• Reviewing and approving/rejecting scores submitted by players
• Ensuring accurate handicap information for all league members
• Payment of your league's subscription fees ($120/year after the 30-day free trial)
• Complying with all applicable laws when managing your league

4.2 League Members (Players)

As a League Member, you are responsible for:

• Submitting accurate scores and scorecards
• Responding to event RSVPs in a timely manner
• Respecting other league members and maintaining sportsmanship
• Following your league's specific rules set by the Commissioner

5. Subscription and Payments

5.1 Free Trial

We offer a 30-day free trial for new leagues. No credit card is required to start your trial. You will receive email reminders before your trial expires.

5.2 Paid Subscription

After your free trial, continued access to GolfSocietyHQ requires a paid subscription:

• Price: $120 USD per league per year
• Billing: Annual subscription, automatically renewed unless cancelled
• Payment: All payments are processed securely through Stripe

5.3 Refunds

Subscription fees are non-refundable except as required by law or at our sole discretion. If you cancel your subscription, you will retain access until the end of your current billing period.

5.4 Price Changes

We reserve the right to change our subscription prices. We will provide at least 30 days' notice before any price increase takes effect. Continued use of the Service after a price change constitutes your acceptance of the new price.

6. Acceptable Use Policy

You agree NOT to use GolfSocietyHQ to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Upload or transmit viruses, malware, or other malicious code
• Harass, abuse, or harm other users
• Submit false, fraudulent, or misleading information
• Attempt to gain unauthorized access to our systems or user accounts
• Scrape, crawl, or use automated tools to access our Service without permission
• Resell, redistribute, or sublicense access to our Service
• Use the Service for any commercial purpose beyond managing your golf league

7. Intellectual Property Rights

7.1 Our Rights

GolfSocietyHQ and all content, features, and functionality (including but not limited to software, text, graphics, logos, and design) are owned by us and are protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of any content you submit to GolfSocietyHQ (such as scorecards, photos, and league information). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and process your content solely to provide and improve the Service.

8. Data and Privacy

Your use of GolfSocietyHQ is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Termination

9.1 By You

You may cancel your subscription and delete your account at any time through your account settings. Upon cancellation, you will retain access until the end of your current billing period.

9.2 By Us

We may suspend or terminate your access to GolfSocietyHQ immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Non-payment of subscription fees
• Fraudulent, abusive, or illegal activity
• At our discretion if we believe termination is necessary to protect the Service or other users

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

GolfSocietyHQ is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties or representations about the accuracy, reliability, or availability of the Service. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2 No Liability for Handicap Calculations

While we strive to provide accurate handicap calculations, we do not guarantee their accuracy or suitability for official golf competitions. GolfSocietyHQ is designed for recreational golf leagues and social play. You are responsible for verifying handicap calculations if used for official purposes.

10.3 Limitation of Liability

To the fullest extent permitted by law, GolfSocietyHQ and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Unauthorized access to or alteration of your data
• Any errors, bugs, or inaccuracies in the Service
• Any conduct or content of third parties on the Service

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless GolfSocietyHQ and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit to the Service

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which GolfSocietyHQ operates, without regard to its conflict of law provisions.

12.2 Informal Resolution

Before filing a formal claim, you agree to contact us at golfsocietyhq@gmail.com to attempt to resolve the dispute informally. We will make good-faith efforts to resolve any issues.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on our Service at least 30 days before the changes take effect. Your continued use of GolfSocietyHQ after the effective date constitutes your acceptance of the revised Terms.

14. Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GolfSocietyHQ regarding the use of our Service and supersede all prior agreements and understandings.
